The ATF raided Ares Armor on March 15th, with a search warrant that was issued after the ATF falsified their application.  The application said they were looking for 80% lower receivers, which are considered firearms under the Firearms Control Act.
In ATF’s ex parte application dated Friday, the agency alleged that it “is conducting a lawful criminal investigation of the illegal manufacture, distribution, sale, and possession of AR-15 variant lower receivers, which are considered firearms under the Firearms Control Act.”
However, 80% lowers are not complete and are not considered firearms under the law.  Outgoing Rep Henry Waxman did propose such a law, but it was never passed leaving the original act intact.  Therefore, whoever signed the application for the search warrant, committed perjury.  That’s the reason they used the ex parte.  Ares could not argue the application was false.  The ATF previously filed a similar application, but Ares was able to get a restraining order based on the inaccuracy of the application.
The ATF will end up in the clear though, because they will send all the records back to Ares (after making numerous copies) and the perjury in the application can only be prosecuted through the Department of Eric Holder (Injustice) and will not happen.  Ares Armor owner, Dimitri Karras can sue, but if he gets his files and anything else taken by the ATF, he cannot do much, unless he can prove they made copies.  Karras does promise to do everything in his power to fight
Here are a couple of videos of the raid.
