Supreme Court Tells Obama He Can’t Vote Present on German Homeschool Family

The Supreme Court has ordered Obama to respond to the appeal by the German family who asked for asylum because German officials were going to take their children because they are homeschooling them.  This places Obama in a precarious position.  He doesn’t want to grant asylum because his bosses at the NEA wouldn’t like it, and on the other hand, the fact that SCOTUS is ordering them to make a determination means that SCOTUS plans to get involved if he turns them down.  And to top that it would be terrible PR.
The Romeike family, who are evangelical Christians,, want to homeschool their kids and keep with their religious beliefs.  They came to the US because German officials had threatened to take their kids away if the homeschooling continued.  The Romeikes then asked for asylum.  That was denied and the Obama administration was set to deport them.  In a last-ditch effort, they appealed the rulings.  The fact that Eric Holder will have to file an actual decision outlining his reasons is a good sign for the Romeike family as it means they intend to take it up.  Otherwise they would have let previous rulings stand.
The Home School Legal Defense Association have taken up the case and are doing the heavy lifting for the Romeikes.
“The government initially waived its right to respond, apparently thinking that Romeike v. Holder wasn’t worthy of the court’s consideration.  Clearly, someone in the Supreme Court disagrees. While the odds of the court taking any case are very low, this has increased the chances—but it is impossible to predict whether the court will ultimately accept the case.”
SCOTUS has ordered Justice to give it an answer by Dec 19th.  In 2010, an immigration judge granted them asylum but then Eric Holder and Barack Obama appealed the decision and won.
Home schooling has been outlawed in Germany since 1918.
